Terms & Conditions

​Terms and Conditions of Service

These T&Cs are for the interest of safety, responsibility and welfare for our clients. We reserve the right to change these terms and conditions at any time. Any changes will take immediate effect and it is the responsibility of our clients to read these.

Please note, payment for services implies agreement with these terms and conditions.

Bookings
No booking is confirmed until payment is made. Confirmation of your booking will be forwarded by email.  It is the client’s responsibility to ensure they arrive at the right venue and at the correct time. We reserve the right of attendance for all courses and training services.

We cannot guarantee a place on a course unless registration has been completed, the appropriate intake forms completed ad payment has been made.  If you request a place on a course without payment, there is no assurance a space will be available on commencement of the course. 

Cancellations, missed sessions, terminations and refunds:
Cancellation requires at least 48 hours notice in order to be eligible for a refund.  Partial refunds will not be given for missed classes.  Please notify us beforehand if you will miss a class -  if at least 48hrs notice is given, make-up classes may be arranged at the discretion of the trainer if there are genuine extenuating circumstances.  Any make-up classes offered for Puppy Preschool classes will expire if not completed before the puppy is 20 weeks old.

A client may cancel a program at any time but refunds will be made at the discretion of the trainer, and client may still be invoiced up to the full amount quoted based on the degree to which the work has been completed and the extent to which time has been allocated to the project that cannot be effectively used to generate revenue that would be otherwise lost.

Private training sessions or consultation can be rescheduled or refunded with at least 48 hours notice. If notice is less than 48 hours, refunding or rescheduled is at the sole discretion of the trainer. 

We reserve the right to reschedule classes and training sessions, providing at least 24hrs notice, with efforts made to accommodate the needs and schedules of trainer and client as best we can.

We endeavour to provide the best service and support for all our clients.  To allow us to do this, we reserve the right to terminate any agreement or contract by written notice and without any refund if any of the following conditions have been met and have failed to be resolved:

  • if the client fails to pay overdue fees

  • if the client breaches any terms of the agreement

  • if the client fails to follow and adhere to provided advice and recommendations such that it interferes with our service.

  • if the client knowingly causes physical, mental or emotional harm to their dog

  • if there is no contact from the client for 120 days, a program or service can be deemed as cancelled at the discretion of the trainer.


Classes:
We limit the number of dogs in our classes to ensure quality of our service. Booking and paying in advance guarantees a place on our courses.

Please contact us if you are not sure whether a class is suitable for your dog. If your dog exhibits any aggression or fear issues, please let us know prior to class so we can assess which class is best for you. If we have agreed to your dog attending a class, but the dog is not suited to the environment, we will endeavour to offer you alternative arrangements, such as working with you on a one-to-one basis.
 

Class and Training Considerations:Please arrive in time for each class as latecomers can be disruptive to others.  Some dogs do better with some time to acclimate to the class environment. Please consider others in class and switch off your mobile phone. We ask that you do not hold conversations on your phone during training.

 

We encourage family members to attend classes and sessions. We do ask any children under the age of 16 are accompanied by an adult and do not disrupt the dogs working. We reserve the right to ask for disruptive attendees to not be brought to future classes; and potentially to leave the class if they are disturbing other owners and dogs. No child must approach other dogs without the owner’s permission and with supervision.  We accept no responsibility for children at classes and it is the responsibility of the supervising adult to ensure the children’s safety at all times.

Training Plans and Recommendation: 
We encourage our clients to contact their veterinary surgeon for a health check and before starting a training plan, especially if concerned about any physical issues. 

The information and any treatment suggested consists of Adaptive Behaviour's personal views and are based on the information given to us by the client or person responsible for the animal(s) and or our own conclusions resulting from personally gained evidence of the animal and the related behaviour.

 

Treatment plans, for the most part, will not be successful overnight. We do not guarantee any results, as each animal is an individual case, and behaviour is subject to multiple factors outside of our control, nor is it possible to foresee if another problem may arise as a result of the treatment. 

Client success will depend on consistency, and effort in implementing our management and treatment plans.  Failure to adhere to our management, behaviour and training recommendations may result in termination of services at the discretion of the trainer, with refunds given at sole discretion of the trainer.  

Safety and Welfare:
As a member of accrediting organisations including the Association of Professional Dog Trainers New Zealand and in accordance with membership Code of Ethics, we practice kind, fair and effective techniques avoiding the need to use physical correction of any type. Harsh handling of dogs is wholeheartedly discouraged and the use of check chains and other coercive or punitive methods, including lead jerking, shouting or smacking, is not permitted.  We do not allow or condone the use of any aversive device or method that causes injury, pain or fear ( e.g. slips leads, shock collars, spray collars, compressed air canisters, rattle cans or water squirters).  We reserve the right to exclude any owner who fails to comply with this request from training services. For training sessions, a comfortable collar or harness and lead and a variety of treats and toys are all that are required.

We provide a safe and secure environment as practicably reasonable and endeavour to apply good practices with all our training services. We aim to run all classes in as safe and professional manner as possible. We also take all reasonable precautions when providing behavioural services to minimise the risk of injury. However remote, dog training is not without risk, and therefore participation in training and behaviour services is at the owner’s risk.

Lavinia Tan, any assistants or helpers, and the owners/landlords of the training class venues will not accept responsibility for any loss, injury or damage to any persons, or dogs attending a course, or to their property howsoever caused during the provision of dog training activities.

All dogs must be kept under the owner’s control and on a lead, except where specifically instructed by our instructors. You are responsible for the conduct of your dog at all times. 

Dogs in an unfit state of health due to illness, disease or injury cannot be brought to class. Do not bring your dog to class if they have been in contact with an infectious disease, such as kennel cough or conjunctivitis. If you unsure as to whether your dog is well enough to attend, please consult your vet. If your dog is unable to attend, you are welcome to attend the class without your dog to maintain continuity of training.

Dogs should be adequately protected by vaccination as advised by your vet and verification may be requested. Puppies can attend our classes from one week after their first vaccination has been administered. Puppies not having completed their vaccinations must not walk on the ground outside of the venue and are to be carried into and out of the facility.

Bitches in season are not permitted to attend a class. Please notify us if you consider your bitch may come into season during a course. Refunds are not given though we may offer alternative arrangements, such as deferring to another course.

In accessing the website, you agree that you will access the contents solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted or distributed without the prior written consent of the copyright holder.

Training notes and resources are distributed for personal, non-commercial use., and 
cannot be altered, modified or reworded for further distribution. Photographs, video or any graphics cannot be used without the accompanying text or without obtaining the permission of the copyright holder.
